Green loses first court battle
A Dane County circuit court judge ruled against Republican gubernatorial candidate Mark Green in his case against the State Elections Board ruling.
Earlier this month the Democrat-controlled SEB ruled that Green could not use $467,844 from his U.S. Congressional campaign fund because it was from political action committees not registered in Wisconsin.
Green was seeking a preliminary injunction against the forfeiture.
In his ruling Judge Richard Niess said that Green would not be irreparably harmed by the forfeiture and that Green will lose his case anyway.
Niess was appointed to the bench by Democratic Gov. Jim Doyle in October 2004.
However, the judge did acknowledge that the case will ultimately have to be answered by the Wisconsin Supreme Court.
Immediately following the ruling the Green for Governor campaign issued a statement saying the money in question was being set aside into a separate account.
"In light of Judge Niess' decision today, Green for Wisconsin will be placing $467,844 into a separate account that will not be accessed by the campaign until there is a final decision on the status of our conversion," the statement said.
The campaign also said it plans on appealing the case to the state Supreme Court.
"As Judge Niess said, the questions surrounding this matter are best addressed by the Supreme Court, which we expect will happen very quickly."
