Child-sexual assault charges were re-filed against a Pierce County Sheriff's Office deputy following a scheduling conflict by the former prosecutor.
St. Croix County Assistant District Attorney Erica Ellenwood is now listed as special prosecutor in the case against 31-year-old Allen J. Wojcik, who faces four felony counts related to sexual assault of a child.
His original case was dismissed after then-special prosecutor, St. Croix County DA Michael Nieskes, said no prosecutor was available for a January trial. The case was dismissed Jan. 16 and refiled Feb. 13. The charges are the same.
Wojcik's initial appearance on the refiled charges was Feb. 25 in Pierce County Circuit Court, where a judicial substitution was requested. A preliminary hearing was held Feb. 28, where Buffalo-Pepin County Judge Thomas Clark found probable cause that a felony was committed in the case.
Trempealeau County Circuit Court Judge Rian Radtke was appointed judge for the case on March 4.
Wojcik pleaded not guilty to the original charges in October. An arraignment date on the refiled charges had not been set as of Monday, March 11.
